Drafting and Filing the OA: Questions and Answers

36 questions on this subject, answered simply by the team of Advocate B.K. Singh. Other subjects are listed alongside, and the main FAQ page lets you search across all 636 questions.

The Original Application is what the tribunal reads first and returns to at every hearing. These answers cover how to prepare one: whom to name as respondents, how to word the reliefs, which annexures and affidavits to attach, the filing fee, e-filing, curing defects, joint applications by several employees, and picking the right bench under Rule 6. Advocate B.K. Singh writes the list of dates before a single paragraph of the OA is drafted.

Can I draft and file the OA myself, without an advocate?

You can. Section 23 of the Act lets you appear in person or engage a legal practitioner, and registries deal with parties in person every week. The tribunal still expects the same format as any other OA, and a self-drafted application often comes back with defects or misses a necessary respondent. Some employees draft it themselves and get it checked once by a lawyer before filing. See arguing your own OA.

Is there a fixed form for an Original Application?

Yes. Form I, set out in the CAT (Procedure) Rules, 1987, is the template every OA follows. It runs from the parties and the order under challenge through jurisdiction and limitation, then facts, the remedies you used, a declaration that no other court has the matter, the reliefs and any interim prayer, the fee, the list of enclosures and finally a verification. Grounds sit with the facts and reliefs. Registry staff tick off each heading, so skipping one is an easy defect.

Who should be the respondents in my OA?

Whoever will have to act on the tribunal's order. In a case against a central ministry, the Union of India comes first, represented by the Secretary of that ministry; after it go the head of department and the officer who signed the order. A notified body like KVS or ICAR is sued in its own name through its head. If the authority that must implement the order is missing, enforcement gets messy later. See whom to make a respondent.

In a promotion or seniority case, must I add the juniors who went ahead of me?

Yes, if your relief would push them down or out. Employees whose promotion or seniority would be disturbed are necessary parties, and an OA without them can fail on that ground alone. Where the affected group is large, the tribunal may allow a few to be joined in a representative capacity, an approach the Supreme Court accepted in Mukul Kumar Tyagi v. State of U.P. (2019). Read more on affected juniors as parties.

How should the relief paragraph of the OA be worded?

Ask for exactly what you need, most important first. Usually that means quashing the impugned order, quoted by number and date, followed by a direction for the consequence: reinstatement, refixation of pay, promotion from a stated date, or release of pension with interest. Rule 10 of the CAT (Procedure) Rules wants one cause of action with reliefs that flow from each other. Our guide on the relief clause has worked wording.

Can one OA challenge two separate orders?

Only if they come from one cause of action. Rule 10 allows plural reliefs that are consequential to one another, such as a penalty order and the appellate order that confirmed it. Two unrelated grievances, say a transfer last month and a pay fixation from 2019, need two OAs. Registries often flag this at scrutiny, and if it slips through, the bench may ask you to choose one grievance and drop the other.

Which documents go into the OA as annexures?

At minimum, the order you challenge, your representation or appeal, any reply, and the rules, office memoranda or earlier judgments you rely on. Each one is a true copy, numbered in sequence, and CAT practice labels the applicant's documents A-1, A-2 and so on, while the department's come later as R-1, R-2. Leave out papers you never mention in the OA. A heavy bundle hides the three documents that actually matter.

Do the annexures need attestation?

They must be true copies, and the advocate or the applicant usually endorses each page as a true copy of the original. Keep the originals safe and in order, because the bench may ask to see them, especially a service book entry or a signed order. Never annex a copy with your own pen marks on it. If an old photocopy is faint, attach a typed version alongside it so the judge is not squinting at the hearing.

How much does it cost in government fee to file my OA?

Very little. The fee fixed by Rule 7 of the CAT (Procedure) Rules is Rs 50 per OA. It has long been paid by a crossed demand draft or an Indian Postal Order in the Registrar's name, but e-filing has changed the method at some benches, so ask your bench registry what it accepts today and confirm the figure. The amount does not rise with your claim: a pensioner chasing lakhs in arrears pays the same small sum as anyone else.

How should the paper book be put together?

The paper book is the bound set the tribunal reads. A usual order is the index, a short synopsis with the list of dates, the OA in Form I with its verification, the annexures in sequence, then any miscellaneous applications such as for interim relief or condonation of delay, and finally the vakalatnama. Number all pages continuously from the first to the last. Our guide to the OA paper book shows the order in detail.

Why do lawyers insist on a list of dates?

Because judges often read it before anything else. It is a one or two page timeline at the front of the paper book: each date, what happened, and the annexure number. A clear list shows at once if the OA is in time, if you used the departmental remedy, and where the department went wrong. When Advocate B.K. Singh prepares an OA, the list of dates comes first and the facts paragraph is written from it, not the other way round.

Does the OA need an affidavit, or is the verification enough?

The OA closes with a verification signed by you, saying which paragraphs you know personally and which depend on records or advice. Applications that travel with it, like a delay condonation or an interim relief application, normally carry a sworn affidavit attested by a notary or oath commissioner. Read every paragraph before you sign. A careless statement verified as true can embarrass you badly once the department's reply points it out.

I am posted in Jaipur but the order came from a ministry in Delhi. Which bench do I file in?

You have a choice under Rule 6 of the CAT (Procedure) Rules. One option is the bench for your present place of posting. The other is the bench where the cause of action arose, in full or in part, and the city where the order was signed often qualifies. So an employee working in Jaipur and challenging a Delhi order can normally file at Jaipur. Picking a third bench with no link to the case invites an objection. See filing your OA.

I retired and moved back to my home town. Can I file at the bench near home?

Yes. Rule 6(2) gives a person who is out of service, whether by retirement, dismissal or termination, one more option: the bench for the place where he lives on the day of filing. Say so in the jurisdiction paragraph, give your present address and keep proof of residence handy. Here's a made-up example: a retired railway fitter from Jabalpur who has settled in Varanasi can file at the Allahabad Bench instead of travelling back to Madhya Pradesh.

Fifteen of us lost the same allowance by one order. Do we each need a separate OA?

No, one OA can do, if the tribunal allows it. Under Rule 4(5)(a) of the CAT (Procedure) Rules, applicants with a common interest in the matter, seen from the cause of action and the relief, may be permitted to file together, and you ask for that leave in a short miscellaneous application. Your case fits well. A group whose dates and facts differ from person to person does not. See joint applications.

Can our employees' association file the OA for its members?

It can, with permission, under Rule 4(5)(b). The OA has to spell out which class, grade or category of employees the association speaks for, and a copy of the resolution and registration papers helps. Benches are more at ease with an association case on a pure policy point, such as an allowance withdrawn for a whole cadre, than on individual facts. One or two affected members joining as co-applicants often heads off an objection.

How does e-filing of an OA work?

CAT runs an e-filing portal where an advocate or party in person registers, uploads the OA and annexures as PDFs and gets a diary number. As reported by PSU Connect on 24 October 2026, a CAT circular of 21 October 2026 aims at uniform filing practice across benches, including bookmarked, searchable PDFs and scrutiny timelines. Some benches still want hard copies after e-filing, so confirm the current practice with your bench registry before relying on the upload alone.

The registry returned my OA with objections. What now?

Cure them within the time the registry allows and refile. Typical objections are pages not numbered, an unsigned verification, faint annexures, missing true copy endorsements, an incomplete index, the fee not attached, or no delay application when the OA is late. Go through the objection slip line by line and note against each point what you corrected. Files left uncured for months may be treated as never filed. See curing filing defects.

How do I write the grounds in my OA?

Grounds are your legal reasons, each a short separate paragraph, often lettered A, B, C. Lead with the strongest: the order was passed by an authority without power, or without hearing you, or against a named rule or office memorandum, or treats you differently from named colleagues in the same position. Tie each ground to a rule number and an annexure. Do not retell the facts, and keep comments about officers out of it.

Should interim relief be asked for in the OA itself?

Form I has its own paragraph for interim relief, and many advocates also file a short miscellaneous application so the bench can pass an order on the first day. Keep the interim prayer narrow: stop the recovery, or keep one post vacant, rather than asking for the whole final relief in advance. Section 24 restricts interim orders made without hearing the department, so serve copies in advance where you can, and show the urgency and the harm with dates and documents.

What is a vakalatnama, and who has to sign it?

It is the written authority that lets an advocate appear and act for you. You sign it, the advocate accepts it, and it goes into the paper book. In a joint OA every applicant should sign, otherwise the advocate may not be treated as appearing for those who did not. If you change lawyers later, the new advocate files a fresh vakalatnama. More on this in our guide to vakalatnama and verification.

Do I have to give the department a copy of my OA before filing?

Many benches expect an advance copy to be served on the central government's standing counsel or on the respondents before the case is listed, with proof of service placed in the paper book. Practice differs from bench to bench, so check with the registry. Once the tribunal issues notice, the department usually gets one month to file its reply under Rule 12, and you get a chance to file a rejoinder after that.

My OA is late. What should I write in the limitation paragraph?

The truth. The limitation paragraph in Form I either states that the OA is within time, with the relevant dates, or admits that it is late and says a separate application for condonation of delay is filed with it. Treating a later reminder's reply as the final order to hide delay rarely works, because the respondents will produce the first rejection. Advocate B.K. Singh prefers to admit the delay openly and explain it month by month.

A new paper turned up after I filed. How do I put it before the tribunal?

Through an additional affidavit or, where the case itself changes, an amendment application, either way with the tribunal's leave. If a fresh order is passed while the OA is pending, such as the rejection of your appeal, amend the OA to challenge it rather than starting another case. New documents supporting existing pleas can come in by additional affidavit. Unexplained late additions can draw costs. See additional affidavits and new documents.

My documents are in Hindi. Do they need translation?

That depends on the bench. Benches in Hindi-speaking states commonly accept Hindi documents, while others may want an English translation of anything in a regional language. A typed translation with a short certificate that it is true and correct usually satisfies the registry. Ask at the filing counter before printing the paper book, because adding translations after an objection costs you a listing date.

I am a widow claiming family pension. In whose name is the OA filed?

In your own name, as the applicant, describing yourself as the widow of the deceased employee with his designation and last office. Attach the death certificate, proof of marriage or relationship, and any family pension papers or rejection letter. Minor children who are also claimants are shown through their mother as guardian. Do not file in the dead employee's name; a person who has died cannot be an applicant.

The applicant died while the OA was pending. What should the family file?

An application to substitute the legal heirs, with the death certificate and something that proves who the heirs are, like a family member certificate or a succession certificate. Do not wait months to do this. Money claims such as arrears or pension survive the death, though a relief like reinstatement can no longer be granted. Once the tribunal allows the application, the case carries on in the heirs' names from the stage it had reached.

How long should an OA be?

Shorter than most people expect. Many service OAs need only eight to twenty pages of pleading, with annexures on top. A judge with thirty cases on the board appreciates a clean list of dates and grounds that fit on a few pages. Advocate B.K. Singh often cuts first drafts by a third, mostly by removing repeated facts and long quotations from judgments that can simply be cited at the hearing.

Can I file an OA against a general office memorandum, not an order in my name?

Yes, where the memorandum already affects you. Section 19 needs an order that aggrieves you, and a general OM applied to your pay or allowance is such an order once it is acted on. If a new OM cuts an allowance for your whole cadre, represent first and then file. Attach the OM and your pay slips before and after, and name the ministry that issued it as a respondent.

My first OA was dismissed. Can I file a fresh one on the same issue?

Not on the same cause of action. Once a matter is decided, res judicata bars a fresh OA on that grievance, and pleas you could have raised the first time may also be shut out. Your options are a review application before the same bench or a writ in the High Court. A fresh OA works only where there is a genuinely new cause, such as a new order passed after the earlier decision.

Do I have to mention earlier cases I filed on the same issue?

Yes. Form I asks you to declare whether the matter was filed earlier or is pending before any court or tribunal. Disclose every earlier OA, writ or suit on the subject, with its number and outcome. Concealment, even innocent, can lead to dismissal with costs once the department points it out. If an earlier case was withdrawn with liberty to file again, quote that order and attach it.

I get transferred often. Which address should go in the OA?

Give a stable address where notices will reach you, usually your permanent home address, and add your current posting separately. Include a mobile number and email, since many registries now send listing information electronically. If you move, tell the registry through a short memo so tribunal notices do not go astray. An order passed in your absence because a notice went to an old office is avoidable.

Can I ask the tribunal to make the department produce its files?

Yes. Section 22(3) gives the tribunal the power to require production of documents, and you can ask for it in the OA or by a separate application. Be precise: name the DPC minutes for a given year, the vigilance file, or the note sheet that led to the impugned order, and say why each matters. A general request for 'all records' is usually refused as fishing.

How soon after filing is an OA listed?

After the registry clears the defects, a fresh OA usually comes up for admission within days or weeks, depending on how loaded the bench is. Real urgency can be mentioned for an earlier date. On that first date the bench may issue notice, admit the case, or close it with a direction to the department. Our guide on what happens at admission explains the next steps.

I filed at the wrong bench by mistake. Is my OA lost?

Not usually. The registry often raises the objection at scrutiny, and the papers can be returned for presentation at the correct bench, though you lose some time. Where a case is already pending and there is good reason to move it, the Chairman can transfer it under Section 25 on an application. It is far simpler to get the Rule 6 choice right before filing, and to state the basis for it clearly in the jurisdiction paragraph.

In a recruitment dispute, should I name SSC or the department as respondent?

Usually both. Name the recruiting body, such as the Staff Selection Commission or UPSC, through its secretary, and the ministry or department whose posts were advertised, through its secretary. If you are claiming a post already given to a particular candidate, that candidate may need to be joined too. The user department matters because it is the one that will issue your appointment letter if the tribunal rules in your favour.
