Service Matters of Central Employees in Ghaziabad: Our Vaishali Office

Ghaziabad central employees and pensioners: when your case goes to CAT Allahabad, when Delhi's Principal Bench is open, and how our Vaishali office can help.

In short. On the tribunal's map, Ghaziabad district belongs to the CAT bench at Prayagraj, so a central employee posted here normally files there, and any later writ is heard by the High Court at Allahabad. Many Ghaziabad residents, though, work in Delhi, and they file at Delhi's Principal Bench instead. Pensioners living here can usually choose between the bench where the dispute arose and Prayagraj. Cases take one to three years if contested. Bring your order and posting details to our Vaishali office or consult online.

Is this your situation?

  • You live in Vaishali, Indirapuram, Vasundhara, Kaushambi or Raj Nagar Extension and work in a central office in Delhi.
  • You are posted in Ghaziabad itself, at the CGST office, the railway junction, Hindon or a Kendriya Vidyalaya, and you have been served an order you think is wrong.
  • You retired from central service and have settled in Ghaziabad, and your pension or dues are wrong.
  • Someone told you that Ghaziabad cases can be filed in Delhi, and someone else said they must go to Prayagraj.
  • A husband, wife or parent died while still in service, and your family in Ghaziabad has been refused family pension or a compassionate job.
  • You are a candidate from Ghaziabad rejected in an SSC, RRB or DSSSB recruitment.
  • Prayagraj is too far to travel to regularly and you need to know what can be done from here.

Posted in Delhi, posted in Ghaziabad, or retired: three different answers

The answer to where your case goes depends on one question more than any other: where are you working on the day you file? If your desk is in Delhi, your case belongs at the Principal Bench at Copernicus Marg, even though you sleep in Indirapuram every night. If your desk is in Ghaziabad district, the bench is the Allahabad Bench at Prayagraj, about 650 kilometres away, even though Delhi is twenty minutes by metro.

Retirement changes the picture. After you stop working, Rule 6(2) adds your home town to the options. For someone living in Ghaziabad that again means Prayagraj, though the bench for wherever the dispute began stays open too. A pensioner whose last office was in Delhi, or whose pension was fixed by a Delhi accounts office, can therefore use the Principal Bench.

A note on this website: it is run by B.K. Singh & Associates, an advocates' firm with offices in Vaishali and Dwarka. It is not the tribunal's site, and official notices, cause lists and the bench table are on cgat.gov.in.

Four Ghaziabad situations and the bench for each

  • You live in Ghaziabad, work in Delhi. Principal Bench, New Delhi, with the Delhi High Court above it for any writ. That is the route for thousands of ministry, railway, postal and Delhi government staff who commute on the Blue Line or by road every day.
  • You live and work in Ghaziabad. Prayagraj is your bench, and the Allahabad High Court would hear any writ. There is one exception worth checking: an order signed in a Delhi office gives Delhi a share of the dispute, and so a possible claim to hear it.
  • You work in Ghaziabad, the order came from Delhi. This happens often, for example with railway staff at Ghaziabad Junction, which comes under Northern Railway's Delhi division. Both benches may be open. The choice should be made carefully and the Delhi link stated clearly in the application.
  • You have retired and live in Ghaziabad. Prayagraj on the basis of residence, or the bench where the dispute arose. Where the last office or the pension sanctioning authority was in Delhi, Copernicus Marg is normally open to you as well.

The provisions behind those answers

Rule 6(1), CAT (Procedure) Rules, 1987

Two facts fix the bench for a serving employee. One is the place of posting at the time of filing. The other is any place where the cause of action, or part of it, arose. A notice or decision sent out from Delhi will usually give Delhi a share in the dispute. Say so plainly in the application and attach the paper that proves it; the registry will not presume it.

Rule 6(2), CAT (Procedure) Rules, 1987

If you are out of service for any reason, retirement, dismissal or termination, your usual residence when you file also counts. Ghaziabad residence leads to Prayagraj.

Section 25, Administrative Tribunals Act, 1985

The tribunal's Chairman has power to shift a case already filed to a different bench. A Ghaziabad employee with a strong practical reason, for example a serious illness that makes travel impossible, can apply. It is decided case by case.

Section 21, Administrative Tribunals Act, 1985

The bench may vary; the deadline does not. You have twelve months from the final order, or twelve months after the department's six-month window on your appeal has closed. Debating which bench to use eats into that time.

Why you should not simply assume Delhi

For years, many Ghaziabad and Noida cases were taken up at the Principal Bench using the Chairman's power under Section 25, mainly because Delhi is so much nearer. That practice was challenged. In May 2025 a single judge of the Allahabad High Court, hearing a writ petition, said the power to transfer cases did not allow one bench to absorb another's territory as a matter of routine, and asked the Central Government to respond. Lawyers at Prayagraj had stopped work over the issue.

We have not seen a final ruling at the time of writing in October 2026. So the safe course for an employee posted in Ghaziabad, with no Delhi link in the dispute, is to file at Prayagraj and ask for video hearings where possible. Filing in Delhi without a proper basis risks the case being returned, and a few months lost can matter when the one-year limit is close.

Where a genuine Delhi link exists, use it openly. Our page on the Allahabad Bench in Prayagraj sets out its territory and working, and the page on Section 25 transfer petitions explains when a transfer can be sought.

Central offices in and around Ghaziabad

The Hindon Air Force Station is one of the larger employers of defence civilians in the district, along with the Military Engineer Services and other units serving it. The civilians file at CAT like other central employees; the uniformed personnel beside them use the Armed Forces Tribunal. Rules for the civilians are explained on our page on defence civilian staff.

Railway staff are another big group. Ghaziabad Junction and the electric loco shed are part of Northern Railway's Delhi division, so many of their orders are issued from Delhi. The CGST commissionerate and income tax offices in Ghaziabad, the head post office and its sub offices, Kendriya Vidyalayas in the city and at Hindon, CPWD divisions, and the ordnance factory at Muradnagar, now part of a defence public sector company, make up most of the rest.

Muradnagar deserves a word of caution. Since October 2021, former ordnance factory staff have been on deemed deputation to the new companies, and whether a grievance goes to CAT or to the High Court depends on its nature and timing. Check before filing.

Pensioners in Indirapuram, Vaishali, Vasundhara and Raj Nagar Extension

Trans-Hindon Ghaziabad is full of retired central government staff, and a good number shifted here after vacating government quarters in Delhi. Their disputes are familiar: a PPO with the wrong pay, a 30 June retiree denied the 1 July increment, an old overpayment being clawed back from pension, family pension refused to a divorced or dependent daughter, or gratuity held back over a departmental case.

For these pensioners the bench choice is usually real. If the last posting and pension sanction were in Delhi, the Principal Bench is available because that is where the dispute arose. Residence in Ghaziabad also opens the Allahabad Bench. Most people choose Delhi for convenience, and that is usually sensible, but the application should say clearly why Delhi has jurisdiction.

Families are a separate group. A widow in Vasundhara whose husband retired from a Delhi office, a dependent unmarried daughter whose name was never added to the family details form, or an elderly parent claiming family pension after a son's death in service all have the same bench choice as the pensioner would have had. The papers that matter most are the employee's last PPO or service record, the family details submitted while in service and the rejection letter.

A short pension is short again every month. Even so, the money you can get back is usually capped at around three years before the date of filing; the Supreme Court's 2008 ruling in Tarsem Singh is the source of that cap. Our page on central government pension disputes covers the common claims.

Working with our Vaishali office, step by step

  1. Book a meeting or a call

Call or WhatsApp to fix a time at Cloud9, Vaishali Sector 1, or for a video meeting. Send scanned papers in advance if you can, so that our time together goes on strategy rather than reading.

  2. Decide the bench before anything else

We note three things: where you work, which office signed the order, and your home address. Rule 6 is applied to those facts, and if two benches are open we discuss which one is better for you, considering travel, any Delhi link and where your records are kept.

  3. Use any remaining departmental remedy

If the time for appeal under the CCS (CCA) Rules or the railway discipline rules has not run out, the appeal is filed first. In other cases a representation through proper channel is sent. This often has to be done before the tribunal will hear the case.

  4. Collect what the department holds

RTI applications are sent for APARs, inquiry records, DPC minutes or pension calculations. Copies of service book pages are requested from the office. This is often the slowest part.

  5. Draft and file

The Original Application is drafted with a chronology, grounds and the reliefs sought. It is filed at the Principal Bench or at Prayagraj, usually through e-filing. For Prayagraj, associate counsel there handles the physical appearances.

  6. Follow the case to its end

You are told each next date and what happened. Once the final order comes, it is sent to the department for compliance, and if the department moves the High Court, the defence of the order begins.

Which High Court hears the writ

There is no High Court in Ghaziabad or anywhere in western UP; the demand for one is decades old. Uttar Pradesh has a single High Court with its seat at Prayagraj and a bench at Lucknow. When the CAT bench at Prayagraj rules on your case, a Division Bench of that High Court, sitting at Prayagraj, hears any writ.

Cases decided at Copernicus Marg are different. Their writs lie to the Delhi High Court. The reason is the Supreme Court's 1997 decision in L. Chandra Kumar: each tribunal bench answers to the High Court of the territory it sits in.

For Ghaziabad residents in PSUs, banks or the armed police forces, CAT is never in the picture; the only question is which High Court can entertain a writ against the order. A decision taken at a Delhi head office often lets them use the Delhi High Court. Our page on service writs in the Allahabad High Court covers the Prayagraj route.

Two neighbours in Indirapuram, two benches

Here's a made-up example. Arif and Deepak live in the same Indirapuram society. Arif is an upper division clerk at the CGST commissionerate in Ghaziabad. Deepak works as a section officer at a ministry near Central Secretariat. In the same month of 2026, both get bad news.

Arif receives a minor penalty under Rule 16: an increment held back for twelve months, after a memo about a delayed file. His appeal is rejected. The order was passed in Ghaziabad and he is posted in Ghaziabad, so his case belongs at the Allahabad Bench. He files online, asks for hearings by video, and the case is handled at Prayagraj by associate counsel.

Deepak finds he has been placed below a batch of juniors in a revised seniority list. He is posted in Delhi and the list was issued in Delhi, so his case goes to the Principal Bench, and he can attend hearings after office. Same building, same morning walk to the metro, two different benches and two different High Courts above them.

This is a teaching illustration only and says nothing about how either case would end.

Papers to bring to Vaishali

  • The order itself, plus the envelope, email or dak entry that dates its arrival.
  • Your current posting order, or for pensioners, the PPO and the last office order.
  • The appeal or representation you sent, with proof of delivery.
  • Any reply, including holding replies.
  • Service book pages, pay fixation statements and MACP orders that relate to the issue.
  • APARs, or the RTI application you have filed for them.
  • For a disciplinary matter: memo of charges, your written defence, the inquiry officer's findings, and both the penalty and appeal orders.
  • In a family pension or compassionate appointment case: the death certificate, family details on record and the rejection letter.
  • Proof of your address in Ghaziabad if you are retired and may rely on Rule 6(2).

People in Ghaziabad who are not under CAT

Quite often the person sitting across the table in Vaishali turns out to be outside the tribunal altogether. Personnel of the NDRF, CISF, CRPF and other armed police forces stationed around Ghaziabad exhaust their own appeal and revision, then petition the High Court. Hindon's airmen and officers use the Armed Forces Tribunal. Read our page on CAPF, PSU and bank staff for these routes.

Employees of public sector companies in the Ghaziabad and Sahibabad industrial belt, and of nationalised bank branches, are in the same boat. Uttar Pradesh government employees, including teachers in UP government schools, and staff of the Ghaziabad Development Authority or the municipal corporation are state or municipal servants; depending on the body, they use the UP State Public Services Tribunal in Lucknow or the High Court.

So the first check is about your employer: a central department, a body notified under Section 14(2), or neither. The wrong forum is the most expensive mistake in service law.

Travel to Prayagraj, and how much of it you can avoid

A case at the Allahabad Bench does not mean a train to Prayagraj for every date. Papers go in online, our associate at Prayagraj covers the routine dates, and the bench hears many matters over video, though its practice shifts from time to time. Most Ghaziabad clients with cases at Prayagraj never go there, or go once for the final hearing if they want to watch it.

What you do need is a reliable way of knowing what happened on each date. Advocate B.K. Singh insists on a short update to the client after every listing, even when the matter is only adjourned, because a client who hears nothing for six months tends to start writing to the department on his own, and that rarely helps.

If your health or circumstances make even the occasional journey impossible and the case is likely to need your presence, a Section 25 transfer application may be considered. It is not granted for convenience alone.

Ghaziabad mistakes that cost people months

  • Filing in Delhi while posted in Ghaziabad, with no Delhi link. The registry or the bench may send it back, and the weeks lost in Delhi are simply gone.
  • Assuming a pensioner must file at Prayagraj. If the dispute arose in Delhi, the Principal Bench is usually open even though you live in Ghaziabad.
  • Treating a PSU or CAPF job like a central government post. BEL, bank and NDRF employees go to the High Court, not CAT.
  • Sending a representation to the wrong office. A Ghaziabad employee whose cadre is controlled from Meerut, Lucknow or Delhi must address the competent authority there, through proper channel.
  • Leaving it until the last month. RTI replies, translations and certified copies take time. Start at least three months before the limitation date.

What differs for officers, Group C staff, candidates and families

Group A and senior Group B officers living in Ghaziabad are usually posted in Delhi, and their disputes over promotion panels, deputation or vigilance clearance arise from decisions in Delhi. Their cases nearly always go to the Principal Bench. Group C staff posted in Ghaziabad itself, such as postal assistants, railway technicians or tax assistants, more often have Prayagraj as their bench, and their cases tend to be about recovery, MACP, transfer or minor penalties.

Candidates from Ghaziabad who applied through the Staff Selection Commission or a Railway Recruitment Board need to look at where the recruiting office is and where the rejection was issued. A DSSSB rejection is a Principal Bench matter. Families claiming family pension or compassionate appointment after a death in service should look at where the employee was last posted and where they themselves now live; often both benches are possible.

Railway staff at Ghaziabad Junction or the loco shed face discipline under the Railway Servants (Discipline and Appeal) Rules, 1968, not the CCS (CCA) Rules, and their appeals generally have to be filed within 45 days. Their retirement benefits are now governed by the railway pension rules notified in 2026, so an older pension circular may no longer be the right one to quote. Gramin Dak Sevaks in the rural parts of the district, around Modinagar, Muradnagar and Loni, are engaged under their own GDS rules, and their disputes over put-off duty, TRCA or engagement are heard by CAT like those of regular postal staff.

Urgent orders: a transfer next week or a recovery from this month's salary

Some orders cannot wait for a normal hearing date. A transfer from Hindon to a station in the north-east with a relieving date three days away, a reversion from an officiating post, or a recovery of several lakh rupees starting from the next salary all need quick action. The first step is the same at either bench: file the application with a request for interim relief, and serve an advance copy on the department's standing counsel so the bench cannot refuse to hear it for want of notice.

Section 24 of the Administrative Tribunals Act limits interim orders made without hearing the other side, so the bench will normally want the department's counsel present or at least informed. Being able to reach the Principal Bench in an hour helps in Delhi-linked cases. For Prayagraj, urgent mentioning through associate counsel and a hearing by video can work, but plan for a few days rather than a few hours.

Be realistic. Transfer orders are stayed only where there is a clear breach of the transfer policy, bad faith or a serious personal hardship that the policy itself protects, such as a spouse posting or a disabled child. Recoveries from Group C staff and pensioners are stayed more often, because of State of Punjab v. Rafiq Masih (2015) and the DoPT instructions that apply it.

When a letter works better than a case

Not every Ghaziabad grievance should go to Prayagraj or Copernicus Marg. A missed increment that the accounts office admits, an allowance stopped because a clerk misread a circular, or a pension calculation with an obvious arithmetic slip can usually be put right by a precise letter quoting the rule, sent to the officer who can actually fix it, with a copy of the relevant order. Many of these get sorted within one or two months.

A case becomes necessary when the department has taken a firm position against you, when money is already being deducted, when a penalty or rejection order has been passed, or when the limitation date is approaching. If you are on the fence, have someone read the papers before you write again, because a loosely drafted letter can admit a fact that later damages your case.

Our Vaishali office

The office is at Cloud9, Tower S3, Vaishali Sector 1, a short walk from Vaishali metro station, at the end of the Blue Line branch that runs straight to Mandi House for the Principal Bench. Clients come from Indirapuram, Vasundhara, Kaushambi, Vaishali, Raj Nagar Extension, Crossings Republik and Sahibabad, and from Noida next door. Read our guide on consulting a service law advocate in Vaishali and Indirapuram for how a first meeting works.

Advocate B.K. Singh handles strategy and drafting in Principal Bench and Allahabad Bench matters, with associate counsel at Prayagraj for appearances there. Advocate Sadhna Singh helps clients organise records and follow up on RTI replies. Fees are settled at the first meeting and written down stage by stage.

For Noida residents, our page on Noida and Greater Noida service cases covers that district, which shares the same bench rules.

This week, if you have an order in hand

Note the date on the order and the date you received it. Write down where you are posted, or where you retired from and where you live now. If the order came from Delhi, keep the envelope or email that shows it. With those three facts, the bench question can usually be answered in a few minutes. If you work in Delhi, our page on central employees in Delhi covers the Principal Bench side in more detail.

To have the papers checked, or to be told when the bench rules for Ghaziabad change, speak to Advocate B.K. Singh.

Frequently asked questions

Which CAT bench covers Ghaziabad?

Ghaziabad district is under the Allahabad Bench in Prayagraj. Employees posted in Delhi, and some pensioners, can use the Principal Bench in New Delhi instead.

Home in Indirapuram, office in a Delhi ministry: which bench?

Copernicus Marg. For anyone still working, the station of posting fixes the bench and the home address does not.

Can a Ghaziabad pensioner file in CAT Delhi?

Often yes, if the last posting, the order or the pension sanction was in Delhi, because part of the dispute arose there. Living in Ghaziabad alone points to the Allahabad Bench.

Is there a CAT bench or circuit sitting in Ghaziabad?

No. There is no tribunal bench in Ghaziabad, and we are not aware of regular circuit sittings of the Allahabad Bench in western UP. Look on cgat.gov.in in case a new notice has been issued.

Must I travel to Prayagraj for hearings?

Usually not for every date. Filing can be done online, counsel at Prayagraj can appear, and many hearings are held by video, though the bench decides when presence is needed.

Which High Court hears a Ghaziabad service writ?

If the Allahabad Bench decided the case, the Allahabad High Court. If the Principal Bench decided it, the Delhi High Court.

I work at BEL in Ghaziabad. Can I go to CAT?

No. BEL is a public sector company and has not been brought under CAT, so its staff go to the High Court by writ.

Where is your Ghaziabad office?

At Cloud9, Tower S3, Vaishali Sector 1, near Vaishali metro station. Meetings are by appointment, and online consultations are also available.

Have a service dispute with the department?

Share the order, charge memo or pension papers with our advocates. You will learn the time limit that applies to you and the step to take first.
