Bhopal Central Employees, Scientists and Pensioners: Jabalpur Bench Cases

Central staff, scientists and pensioners in Bhopal file service cases at the CAT Jabalpur Bench. Forum, writs, time, papers and what to do this week.

In short. Bhopal has no bench of the Central Administrative Tribunal. A central employee, scientist, pensioner or candidate whose dispute arises in Bhopal files at the CAT Jabalpur Bench, which covers Madhya Pradesh and Chhattisgarh, and any later writ goes to the Madhya Pradesh High Court, also at Jabalpur. A contested case commonly takes one to three years. Most dates are handled by counsel, so you seldom need to travel. Start by checking the date of the order against you and whether your departmental appeal or representation has been decided.

Is this your situation?

  • You work at a CSIR, ICAR or ICMR institute in Bhopal and your assessment promotion or pay upgradation has been delayed or refused.
  • You are on the Bhopal division of West Central Railway, or retired from it, and your pay, promotion or pension is wrong.
  • You are in the postal circle office, income tax, GST, a KV or a defence establishment in Bhopal and have received a penalty, transfer or recovery order.
  • You retired on 30 June or 31 December and your pension still does not count the increment you earned.
  • You applied for a central government job from Bhopal and were rejected at document verification or medical stage.
  • You are not sure whether your employer, such as BHEL, AIIMS or IISER, comes under the tribunal at all.
  • You are worried about having to travel to Jabalpur again and again.

No bench in Bhopal, so the file travels to Jabalpur

The capital of Madhya Pradesh has the Secretariat, dozens of central offices and research institutes, and a large community of central government pensioners. It does not have a bench of the CAT. Every central service case from Bhopal is filed at the Jabalpur Bench, roughly 300 km to the east, which also hears matters from the whole of Chhattisgarh.

For most clients this matters less than they fear. A service case is argued on documents. Your lawyer attends the dates, the order sheet reaches you the same evening, and you are needed in person only if the bench specifically asks or if a settlement meeting with the department is on the cards. Many Bhopal clients never see the tribunal building.

What does matter is getting three things right before filing: whether your employer is under the tribunal at all, whether the departmental route has been used or has run out, and whether the one-year limit is still open. The rest of this page goes through those questions with the offices and situations we see most often from Bhopal.

Three places that shape a Bhopal service case

  • The office that passed the order. It may be in Bhopal, in Jabalpur (where West Central Railway has its headquarters), or in Delhi (a ministry, the CSIR or ICAR headquarters, a directorate). Where the order was made can open a second bench as an option, so note the exact office and the signing officer.
  • The CAT Jabalpur Bench. This is where the Original Application is ordinarily filed and argued. It covers all of Madhya Pradesh and Chhattisgarh.
  • The Madhya Pradesh High Court. Its principal seat is also at Jabalpur, with benches at Indore and Gwalior. A writ against an order of the Jabalpur Bench is filed before a Division Bench of the High Court, following L. Chandra Kumar (1997). Bhopal district falls under the principal seat.

Circuit sittings in Madhya Pradesh and Chhattisgarh

The tribunal's official jurisdiction table lists the Jabalpur Bench against Madhya Pradesh and Chhattisgarh without naming any circuit sittings. In practice, benches have sat away from their seat from time to time under orders of the Chairman, and Law Ministry panel lists for Chhattisgarh refer to a CAT circuit at Bilaspur. We have not found a regular sitting in Bhopal.

Circuit arrangements change with the number of Members and the pending load, and a notice can appear or lapse without much publicity. If your matter is old, or connected to a group of cases from the same office, ask whether a circuit list exists that would suit you. Do not delay filing in the hope of one, because the one-year limit keeps running.

The rules behind the forum and the timing

Section 14, Administrative Tribunals Act, 1985

This section draws the tribunal's boundary. Inside it are anyone holding a civil post of the Union, civilian staff of the defence services, and employees of societies, corporations and institutes that the Centre has chosen to add by notification under sub-section (2). A ministry office or a department on Arera Hills is plainly inside. Autonomous institutes are covered only if notified, which is why the first question for anyone at AIIMS, IISER, NITTTR or a university is about the notification, not the merits.

Rule 6, CAT (Procedure) Rules, 1987

Your present posting is the usual key: an employee at a Bhopal office files at Jabalpur. A bench elsewhere may also be open if some part of the grievance happened in its area, for instance where a Delhi headquarters signed the order. People who are no longer in service because they retired, were dismissed or were terminated get an extra choice, the bench for the place they live in now. That is how a man who retired from a Nagpur office and moved to a flat on Kolar Road ends up filing at Jabalpur rather than Mumbai.

Section 21, Administrative Tribunals Act, 1985

You have a year. It starts on the date of the final order, or, if your appeal or representation simply sat unanswered, on the day the six-month waiting period ran out. A fresh letter every few months does not restart that year; S.S. Rathore (1989) is still the case departments cite against people who tried. Missed it? Then the application has to come with a separate plea explaining, period by period, why you could not file sooner; see condonation of delay in filing.

Section 24, Administrative Tribunals Act, 1985

Interim orders, such as staying a recovery or a transfer, can be passed only after the department has had a chance to be heard, unless the bench records reasons for acting at once and the interim order is limited in time. That is why urgent matters from Bhopal need complete papers on the first day.

Scientists and technical staff in Bhopal's research institutes

Bhopal has an unusual number of central research establishments for a city of its size: the CSIR's Advanced Materials and Processes Research Institute, the ICAR's agricultural engineering and soil science institutes, a high security animal disease laboratory, and an ICMR institute for environmental health research. Their scientists and technical officers bring a distinctive set of disputes.

The most common is the assessment promotion. CSIR, ICAR and other scientific bodies run in-situ promotion schemes where a scientist moves up after a fixed residency period if an assessment committee clears him or her. Disputes arise when the assessment is delayed for years, when the cut-off date is moved, when a lower grading in a single year blocks the move, or when promotion is given from the meeting date instead of the date it fell due. Recruitment and assessment rules differ between these bodies, so we read the scheme that applied in your year before advising. See our pages on scientists in CSIR, DRDO and ISRO and ICAR scientists and staff.

Technical and administrative staff in these institutes face more ordinary questions: MACP, seniority between merged cadres, deputation and transfer to other labs. CSIR and ICAR are notified under Section 14(2), so their staff come to the CAT. For ICMR institutes, check the notification status for your institute before filing.

Railway staff on the Bhopal division

The Bhopal division of West Central Railway takes in busy stations such as Itarsi, Vidisha and Bina, and its headquarters zone sits in Jabalpur, a few kilometres from the tribunal. That is a convenience: the General Manager's office, the zonal personnel branch and the tribunal are in the same city, and records can be inspected without a long trip.

Discipline on the railways follows a separate code, the Railway Servants (Discipline and Appeal) Rules of 1968, and an appeal against a penalty under it has a 45-day window in most cases. Railway pension law changed this year: new rules for railway pensions were notified in January 2026 and took the place of the 1993 set, though a person who retired years ago may still have a claim that turns on the old text. Running staff pay, medical decategorisation, and selection for promotion through written tests are frequent disputes. Our page on railway employees' service cases sets out how these move.

Posts, taxes, schools and defence civilians

The Madhya Pradesh Postal Circle is headquartered in Bhopal, and its divisions reach Gramin Dak Sevaks in villages across the state. GDS put-off-duty orders, TRCA and conduct cases, and postal assistants' departmental examination results are regular matters. The income tax and GST establishments for the region have their senior offices in Bhopal, and inspectors there often dispute inter-charge transfers and promotion seniority.

Kendriya Vidyalaya and Navodaya teachers in and around Bhopal raise transfer, displacement and pay questions; see KVS and NVS teachers. Defence civilians at the EME Centre and other units of the Bhopal military station work under the CAT for their civil service matters, while soldiers serving alongside them go to the Armed Forces Tribunal. Civilians in defence units are covered on our page for defence civilian staff.

Bhopal employers whose staff do not go to the CAT

  • BHEL. The Bhopal plant of Bharat Heavy Electricals is a public sector undertaking. Its employees file writs in the Madhya Pradesh High Court, or use industrial law, depending on the dispute.
  • Banks and insurance companies. Public sector bank and insurer staff are also outside the tribunal and go to the High Court.
  • Madhya Pradesh government employees. State staff, including those in the Secretariat at Vallabh Bhawan, go to the High Court. Madhya Pradesh has had no state administrative tribunal for over two decades.
  • Soldiers and CAPF. Army personnel go to the Armed Forces Tribunal. CRPF, BSF and other central armed police personnel generally file writs in the High Court.
  • Autonomous institutes not notified. IISER Bhopal, universities and similar bodies need to be checked against the Section 14(2) notifications. Newer AIIMS were reported brought under the CAT by a notification of 13 January 2026; AIIMS Bhopal staff should confirm whether it covers them. Our page on writs for CAPF, PSU and bank employees helps those who fall outside.

Retired in Bhopal: pension, the June increment and family pension

Bhopal is home to many retired central employees, including people who served in Delhi, Mumbai or the north-east and settled here for family reasons. As retirees, they may file at Jabalpur on the strength of their Bhopal residence.

The question we are asked most by Bhopal retirees this year is about the increment they missed by retiring a day too early. Someone who served a full year to 30 June, or to 31 December, used to lose the increment due the next morning. The Supreme Court changed that for pension purposes in 2023 and gave further directions in February 2025, and DoPT followed with memos in October 2024 and May 2025. In broad terms, pension is recalculated with a notional increment, the higher amount runs from 1 May 2023 for most people, and nothing already paid is to be taken back. It does not raise gratuity or leave encashment, and whether family pension and commutation should also rise is still being argued. See the 30 June retiree increment before writing to your office.

Here's another made-up case to show how family pension disputes look. A trackman's widow in Itarsi is refused family pension because her husband's nomination and family form list his mother but not her, since they married after he filled it. The answer is usually documents: the marriage proof, the service book entries and an application to correct the record, followed by a case only if the office still refuses. Our page on central pension disputes covers this ground.

The first month after an adverse order: a Bhopal timeline

Nothing here is a fixed schedule. It shows what should happen in what order, so that no deadline is lost.

  1. Days 1 to 3: secure the order

Keep the original order and the envelope or e-office record showing when you received it. If the order refers to documents you have not seen, such as an inquiry report or a committee's minutes, list them.

  2. Week 1: consult

Send us the order and your service details by WhatsApp or email and fix an online consultation. The first thing Advocate B.K. Singh looks for is the signature block: which officer passed the order, and under what power. An appeal, its time limit and the authority it goes to all follow from that.

  3. Weeks 1 to 4: use the departmental remedy

If an appeal is available, file it within the time the rules allow, which for most penalty orders under the CCS (CCA) Rules is 45 days. If no appeal lies, send a reasoned representation through proper channel. Ask for documents under RTI in parallel where needed.

  4. When something is urgent: go straight to the tribunal

If a recovery is about to start, a transfer is being enforced or a promotion panel is about to be operated, waiting six months makes no sense. The tribunal can entertain an application earlier where the remedy is ineffective, and an interim order can be sought.

  5. Filing at Jabalpur

The Original Application is filed by e-filing or physically, with a list of dates, grounds, relief, annexures and the fixed fee of Rs 50 under Rule 7 (confirm the current fee and mode with the registry).

  6. After filing

Notice is issued, the department replies, a rejoinder follows, and the case waits for final hearing. We send you each order and tell you plainly if the department's reply raises something you need to answer.

For a closer look at how the application itself is put together, read our page on preparing an Original Application.

A technical officer at a Bhopal laboratory and a promotion that came three years late

Here's a made-up example. Ms Kavita Malviya joined a central research laboratory in Bhopal as a technical assistant and became eligible for assessment to the next grade in 2021. No assessment was held for her batch until 2024. When the committee finally met, it promoted her from the date of the meeting, not from 2021, and assessed her on a newer set of criteria that had come in during 2023.

She first asked for reconsideration through her Director, which was rejected in two lines. Under RTI she obtained the minutes, which showed that the committee had not considered whether the older criteria applied to people who were due before 2023.

Her OA at Jabalpur asked for assessment under the criteria applicable on her due date and for promotion from that date. After hearing both sides, the bench in our illustration directed the department to reconsider her case under the rules in force in 2021 and pass a reasoned order within a fixed time. A remand of this kind is common in assessment disputes. It is not a win in itself; the department decides again, and the outcome depends on her record.

Before the first call: a Bhopal checklist

  • The order you want to challenge and the date it reached you
  • Your appeal or representation, with proof of sending
  • Any reply, even a one-line rejection
  • Your appointment letter and the recruitment or assessment rules for your post
  • Service book or e-Service Book extract, with pay fixation statements
  • APAR copies for the years in question, if promotion is involved
  • For pensioners: the PPO, revised PPO, bank deduction entries and any recovery notice
  • For candidates: the advertisement, admit card, result notice, rejection letter and your category or disability certificate
  • English translations of any key Hindi documents, in case the registry asks

Getting to Jabalpur, and when you need not go

Bhopal to Jabalpur is an overnight train journey or a long day on the road. Most of our Bhopal clients come once at most, and many not at all. Signatures for the application and affidavit can be done before a notary in Bhopal and couriered.

Video hearings have been used by CAT benches since 2020, and the Jabalpur Bench's current practice on online appearance should be checked from its notices before you rely on it. If the bench wants the employee present, for example to explore a settlement or to record a statement, we tell you well in advance.

Our guide on briefing a service lawyer online from another state explains what to scan, how to label it, and how to keep a copy set at home.

Mistakes that cost Bhopal clients time

  • Going to the High Court first. A central employee who files a writ in the High Court about a transfer or a penalty is usually told to go to the CAT. Months are lost.
  • Assuming BHEL or a bank is under the CAT. It is not. Their staff must go to the High Court or the labour forums.
  • Waiting for the full six months when the harm is now. If a recovery has begun, file with an interim application rather than waiting for the department's reply.
  • Leaving out the headquarters. In CSIR, ICAR or railway cases, the order may be implemented in Bhopal but decided in Delhi or Jabalpur. The deciding authority must be a party.
  • State certificates for central jobs. Candidates often submit a Madhya Pradesh OBC certificate when the central list and format are required. The certificate must be held by the closing date and in the prescribed format, as recent Supreme Court rulings stress.
  • No translation ready. A key Hindi document without a translation can slow scrutiny if the registry asks for one.

Transferred out of Bhopal at short notice

A transfer order is the most frequent reason a serving Bhopal employee calls in a hurry, and also the one where the tribunal is most cautious. Transfer is treated as an incident of service. The bench will not step in merely because the new station is inconvenient or far from family; it looks for a breach of the transfer policy, a malafide motive, an order passed by someone without the power, or a transfer used as a punishment in disguise.

Timing matters more here than anywhere else. Once you have been relieved and the post filled, an interim stay is far harder to get, so a representation and, if needed, an OA should go in before the relieving date. Couples posted in Bhopal can point to the DoPT guidelines of 30 September 2009 on posting spouses at the same station, which are guidelines and not an enforceable right, but which the department must consider. Our page on challenging a transfer order sets out what benches accept and what they do not.

Candidates applying from Bhopal

Bhopal sends a large number of candidates to SSC, UPSC, railway and other central recruitments. When they are rejected for a central civil post, for example at document verification, for age, for a category certificate, or after a medical examination, the CAT is the forum. A candidate may generally file where the cause of action arose, which can include the place of the selection process or the place where a rejection was received.

Recruitment for the central armed police forces, such as SSC GD constable and CAPF sub-inspector posts, is different. Those disputes generally go to the High Court, most often in Delhi, not to the CAT. Our page on SSC candidates' disputes explains how quickly these need to move, since appointment processes do not wait.

Group A officers, Group C staff and pensioners: different starting points

An officer in Group A, such as a deputy commissioner of income tax or a senior postal superintendent, usually fights APAR gradings, DPC benchmarks and seniority. Under the DPC guidelines of March 2024, the benchmark for promotion to Level 12 and above is Very Good, so a single downgraded APAR can matter. These files are often decided in Delhi.

Group C staff more often face pay fixation, MACP, recovery and minor penalty questions decided locally. Recovery from Group C staff has extra protection under Rafiq Masih (2015). Pensioners face delays in gratuity and commutation, where Rule 65 of the CCS (Pension) Rules, 2021 allows interest. Each group needs a different first letter, and Advocate B.K. Singh tends to spend the first consultation finding out which letter that is.

Working with us from Bhopal

Our offices are in Dwarka, New Delhi and Vaishali, Ghaziabad. For Bhopal clients we work through online consultation, appear on brief at Jabalpur, and coordinate with associate counsel at the Jabalpur Bench when a matter needs someone on the spot at short notice. High Court writs and Supreme Court matters are handled with Advocates-on-Record where needed.

Our charges are settled with you at the start and written down stage by stage, so the cost of a writ, if one is needed later, is a separate conversation and not a surprise. See how we work and charge. For the bigger regional picture, our page on the Jabalpur Bench gives the wider picture for Madhya Pradesh and Chhattisgarh.

Frequently asked questions

Is there a CAT court in Bhopal?

No. Bhopal cases are filed at the CAT Jabalpur Bench, which covers Madhya Pradesh and Chhattisgarh. Ask the registry whether any circuit sitting is listed, but do not delay filing for one.

Do I have to travel from Bhopal to Jabalpur for every hearing?

No. Counsel attends the dates and you get the order the same day. You may be asked to come if the bench wants you present, which is uncommon.

I work at BHEL Bhopal. Can I file in the CAT?

No. BHEL is a public sector undertaking and is not under the tribunal. Service disputes there go to the High Court or to the labour forums, depending on what the dispute is about.

Can a CSIR or ICAR scientist in Bhopal go to the CAT?

Yes. Both bodies are notified under Section 14(2), so their scientists and staff file at the Jabalpur Bench. Check the assessment scheme that applied on your due date before filing.

Where does the appeal against a Jabalpur Bench order go?

Strictly there is no appeal; the challenge is a writ petition, heard by two judges of the Madhya Pradesh High Court at Jabalpur. The Supreme Court is the step after that, by special leave.

I retired in Bhopal after serving in Delhi. Which bench do I use?

Your Bhopal home is enough to let you file at Jabalpur, because retired people can sue where they now live. If the pension order came from a Delhi office, the Principal Bench is another option worth weighing.

I am a Madhya Pradesh government employee. Is the CAT for me?

No. The CAT deals with central government matters. State employees in Madhya Pradesh file writs in the High Court.

What does the tribunal charge to file a case?

Almost nothing: Rule 7 fixes the application fee at Rs 50, and the Jabalpur registry can tell you if that or the payment method has changed. Your real outlays are photocopying, the notary and courier. What we charge is put in writing before work starts.
