Patna Bench jurisdiction over Jharkhand, its Ranchi circuit, and the filing rules in Rule 6 (1987 Procedure Rules) and Sections 14 to 21 of the 1985 Act

Ranchi Central Employees, Railway Staff and Pensioners: Service Cases

Ranchi and Jharkhand central staff, railway employees and pensioners: Patna Bench, the Ranchi circuit, which High Court, who is outside CAT, and next steps.

In short. If you hold a central government post in Ranchi, or anywhere in Jharkhand, or draw a central pension there, your service case goes to the CAT's Patna Bench, which sits in circuit at Ranchi for set periods. Whether a given date is in Ranchi or Patna turns on the listing at the time. Railway staff, postal workers, auditors, tax officers and central pensioners all come here, but CCL, HEC and other PSU employees do not. A defended case usually takes one to three years. First, note when the order reached you and whether your appeal or representation is still pending.

Is this your situation?

  • You work with the railways at Ranchi, Hatia, Muri, Dhanbad or Chakradharpur and a promotion, pay or penalty order has gone against you.
  • You are a Gramin Dak Sevak or postal employee in Jharkhand who has been put off duty, charged or refused a benefit.
  • You are in the Accountant General's office, income tax, GST or a Kendriya Vidyalaya in Ranchi and face a transfer, recovery or adverse APAR.
  • You are a retired central employee in Ranchi and your pension, family pension or gratuity is short, late or being recovered.
  • You applied for a central job and the recruitment board rejected your Jharkhand caste or residence certificate.
  • You work for CCL, HEC, MECON or SAIL and want to know if the tribunal can help you.
  • You have heard the tribunal sits in Ranchi only some weeks and are unsure whether you will have to go to Patna.

Ranchi cases belong to the Patna Bench, with sittings in Ranchi

Jharkhand never got its own bench of the Central Administrative Tribunal when it was carved out of Bihar in 2000. Both states remain under the Patna Bench, whose office is on Bailey Road in Patna. To spare Jharkhand litigants the journey, the Patna Bench has for years sat in circuit at Ranchi, and Jharkhand cases are numbered and listed for those sittings.

A permanent bench in Ranchi has been demanded for a long time. A public interest petition on this is pending in the Jharkhand High Court; reports from July 2026 say the petitioner put the number of pending central service cases from Jharkhand at over 800, that the state government has set aside about two acres for a building, and that the High Court asked DoPT and the Law Ministry to explain why the proposal had not moved. Until a bench is actually notified, plan on the Patna Bench and its circuit.

For an employee or pensioner in Ranchi, the practical question is not which law applies but where the hearing will be and who will attend. The answer is usually that counsel attends, in Ranchi when the circuit sits and in Patna otherwise, and that you come only when your presence would make a difference.

Ranchi or Patna: how your matter gets listed

Circuit sittings run for set periods fixed by the tribunal, not every week of the year. When the circuit is not sitting, urgent Jharkhand matters may be mentioned at Patna, and routine dates simply wait for the next Ranchi session. Members, schedules and listing practice change, so the safe course is to check the Patna Bench's notices on cgat.gov.in and the cause list before every date.

If your matter needs an urgent interim order, for instance to stop a recovery that starts next month, do not wait for the circuit to return. Counsel can move it at Patna. If your case is part of a group of identical claims from one office, ask for it to be tagged with the others so they are heard together in one sitting. Our guide on joining a CAT hearing by video explains what to do if a bench permits online appearance on a given day.

None of this is special to Ranchi city. An auditor in Jamshedpur, a coal-belt railway clerk in Dhanbad, a postal assistant in Hazaribagh and a KV teacher in Bokaro all file with the same Patna Bench and are listed at the same Ranchi circuit. For people in Daltonganj or Garhwa in the north-west, Ranchi is still a long bus ride, but the circuit saves most of them the longer trip across the Ganga to Patna. What changes from place to place is the office that holds your file: the DRM's office, the postal division, or the zonal headquarters outside the state, which can slow down record collection more than any court date.

Rules that decide where a Jharkhand case is filed and heard

Rule 6(1), CAT (Procedure) Rules, 1987

The bench is chosen by your posting on the day you file, or by where some part of the grievance arose. A Ranchi posting means the Patna Bench. If you were posted at Ranchi when the order was passed but have since been shifted to Asansol, you may still be able to file at Patna because part of the cause arose in Jharkhand, though the Kolkata Bench would also be open.

Rule 6(2), CAT (Procedure) Rules, 1987

Once a person is out of service, through retirement, dismissal or termination, the home address becomes a second key to the bench. A retired central employee living in Ranchi can therefore come to the Patna Bench even if his whole career was in Odisha. The application should state the residence clearly, with proof, because a territorial objection is easier to avoid than to answer later.

Section 19(4), Administrative Tribunals Act, 1985

Once your application is admitted, any pending departmental appeal or representation on the same grievance comes to an end. So if you file while an appeal is pending, the department may stop deciding it. That is one more reason to choose the timing of an OA with care.

Section 25, Administrative Tribunals Act, 1985

Moving a case from Patna to some other bench, or the reverse, needs an order of the tribunal's Chairman. Such orders are rare, sought where there is serious hardship or a strong link with matters at another bench; our page on requests to move a case between benches explains the test.

Which High Court hears a challenge: Jharkhand or Patna

The 1997 Constitution Bench ruling in L. Chandra Kumar sends anyone unhappy with a CAT order to two judges of a High Court, in writ. Where the order came out of a Ranchi circuit sitting in a Jharkhand matter, petitions have been taken up by the Jharkhand High Court at Ranchi. In one 2017 decision, for example, its Division Bench examined an order passed at the Ranchi circuit and set it aside on the ground that the tribunal had no territorial jurisdiction, because the posting and the orders were all outside Jharkhand.

That case carries two lessons. First, the Jharkhand High Court is a working forum for Ranchi circuit orders. Second, territory is policed by the courts: a case that does not properly belong to the Ranchi circuit can be thrown out late, after years of waiting. When we file a Jharkhand matter, the territorial facts go into the application in plain words.

Where a Jharkhand employee's case was decided at Patna itself, the Patna High Court is the obvious forum, though Article 226(2) may allow the Jharkhand High Court too if part of the cause of action arose in the state. Choose with advice. Our page on writ petitions against tribunal orders explains the grounds and timing.

Coal, steel and heavy engineering: why most Ranchi PSU staff are not CAT cases

Ranchi is the headquarters of Central Coalfields Limited and home to Heavy Engineering Corporation, MECON and SAIL's research and engineering units. Bharat Coking Coal is in Dhanbad. Together they employ far more people in Jharkhand than the central government departments do, and their staff often assume the CAT is their forum because the companies are owned by the Centre.

It is not. Public sector companies have not been brought under the tribunal, so their officers go to the Jharkhand High Court in writ, and their workmen often use the industrial and labour forums. Coal sector pensions under the coal mines pension scheme are also outside the CAT. Our page on service writs for PSU, bank and CAPF staff explains how those cases run.

Jharkhand also hosts thousands of CRPF and other armed police personnel on deployment. Their service grievances are not for the tribunal either; after the force's internal appeal, a writ is the usual course. A soldier from the Dipatoli cantonment takes his grievance to the Armed Forces Tribunal. And anyone on the Jharkhand government's rolls, from a para teacher to a police sub-inspector, files in the Jharkhand High Court, because Jharkhand has no administrative tribunal of its own. Staff of the Central University of Jharkhand and IIM Ranchi should check the Section 14(2) notifications, which usually do not cover such institutions.

Railway staff in Ranchi, Hatia, Dhanbad and Chakradharpur

Railways are the largest group of central employees in Jharkhand, and they are split between zones. The Ranchi and Chakradharpur divisions belong to South Eastern Railway, headquartered at Garden Reach in Kolkata. The Dhanbad division belongs to East Central Railway, whose headquarters is at Hajipur in Bihar. So a Ranchi-based trackmaintainer's promotion may be decided in Ranchi, his seniority list in Kolkata, and a policy circular by the Railway Board in Delhi. Each of these offices may need to be a party.

What brings railway men and women from Hatia and Muri to us? Mostly four things. A promotion selection where the written test marks or the viva looked wrong. A medical board that declared a loco pilot or a pointsman unfit for his category, followed by a long wait for a suitable alternative post. Mileage and other running allowance elements left out of pay or pension. And penalties imposed under the 1968 discipline and appeal rules that apply only to railway servants. For pensions, the rule book itself changed in January 2026, when fresh railway pension rules replaced those of 1993; anyone who retired earlier may still find the older rules decide his claim.

Railway Protection Force members are a special case. In January 2026 the Delhi High Court held, in Union of India v. Kapil Gurjar, that the CAT hears disputes about RPF recruitment, but that service disputes of serving RPF members are not before the CAT. Our page for railway employees covers the main railway disputes in more detail.

Gramin Dak Sevaks and postal staff across Jharkhand

The Jharkhand Postal Circle is headquartered in Ranchi, and its branch offices run deep into Gumla, Simdega, Latehar, Khunti, Palamu and Santhal Pargana. Gramin Dak Sevaks in these places face put-off-duty orders after a cash or stamp shortage, disputes over their time-related continuity allowance slab, and termination for alleged misconduct. Their engagement rules are separate from the CCS rules, but they hold civil posts and the CAT hears their cases.

A put-off-duty order that drags on for months without a charge sheet is the commonest GDS problem we see from rural Jharkhand. The sevak is usually paid only ex gratia compensation during that period, which in a poor household is a real hardship. Our guide on GDS put off duty and ex gratia explains the rules, and the page on postal employees and GDS covers the wider picture.

Other central offices in Ranchi whose staff use the tribunal

  • Audit and accounts. The Accountant General's offices for Jharkhand are in Ranchi. Departmental examinations, MACP and pay fixation are frequent issues.
  • Income tax, GST and customs. Inspectors, tax assistants and officers posted in Ranchi, Jamshedpur and Dhanbad, often disputing transfers to distant charges and promotion seniority.
  • Kendriya Vidyalayas and Navodaya Vidyalayas. Teachers across the state, including in remote JNVs, with transfer, pay and disciplinary matters.
  • ICAR and other research establishments. The ICAR institute at Namkum and the regional research centre at Plandu employ scientists and technical staff whose assessment promotions are a regular source of cases.
  • Defence civilians. Civilian staff in the Ranchi military station and other units in Jharkhand come under the CAT for their service matters.
  • AIIMS Deoghar. Newer AIIMS were reported brought under the CAT by a notification of 13 January 2026. Staff should confirm whether their institute is covered before choosing a forum.

From your first message to a listed case

This is how a matter usually moves for a client in Ranchi or elsewhere in Jharkhand working with us from Delhi NCR.

  1. Share the order and the dates

Send a clear photograph of the order and any letters before and after it. Tell us the date it was received, your post and pay level, and where you are posted now. Advocate B.K. Singh usually reads the dates before anything else, because a lapsed limitation changes all the advice.

  2. Consultation by video or phone

We go through the facts, decide whether you need the tribunal or a further departmental step, and list the missing papers. If the case is weak, we say so and suggest what else may help.

  3. Close the departmental route

If an appeal lies, it is filed in time. If not, a reasoned representation goes through proper channel. Where a recovery or transfer is imminent, we may go to the tribunal at once with an interim prayer.

  4. Draft and sign

We draft the Original Application with a chronology, grounds and relief. You check every fact. Signatures and the affidavit can be done before a notary in Ranchi and sent by courier.

  5. File with the Patna Bench

The OA is filed electronically or at the registry, with the fixed fee prescribed by Rule 7, currently Rs 50 (ask the registry to confirm the amount and mode). We request listing at the Ranchi circuit where that is the practice.

  6. Hearings

The bench issues notice, the department files its reply, we file a rejoinder, and the case waits for final arguments. You receive every order on the day it is passed, with a short note on what it means.

A branch postmaster in Latehar, put off duty for eleven months

Here's a made-up example. Shri Etwa Kujur had served nineteen years as the BPM of a small branch office in a Latehar village. After an inspection found a cash shortfall of about Rs 18,000, which he says came from a robbery he had reported to the local police, he was put off duty. Eleven months later he had received no charge sheet and was living on ex gratia compensation.

His nephew, a clerk in Ranchi, contacted us. We asked for the put-off-duty order, the inspection report, his complaint to the police and the receipt of his representations. A fresh representation went to the divisional head, pointing out the long delay and asking either for a charge sheet or for him to be taken back. It went unanswered.

An OA was filed with the Patna Bench and listed at the Ranchi circuit. The bench directed the department to decide within a fixed time whether to issue a charge sheet, and to take a decision on his continued put-off-duty status. The department later issued a charge sheet, and the inquiry continues. An outcome like this is a step forward, not an end, and every case turns on its own records.

Retired in Ranchi: pension claims that keep coming up

Central pensioners in Ranchi include people who served all over eastern India and settled near family. Their claims are usually about delay, short calculation or recovery. Under the CCS (Pension) Rules, 2021, delayed gratuity or pension can attract interest under Rule 65, and Rule 66 does not allow a sanctioned pension to be reduced except to correct a clerical error. Recoveries from retirees are restricted by Rafiq Masih (2015), subject to any undertaking signed at the time of pay fixation.

Old arrears need care. For pay claims, benches still often limit arrears to about three years before filing, following Tarsem Singh (2008). For pensions the Supreme Court has gone the other way in 2026, ordering family pension arrears in full from the date of death in Maya Banerjee. Check the current position for your claim, and file promptly rather than waiting for a perfect file. Our page on family pension claims deals with widows' and children's cases.

Candidates from Jharkhand and certificate problems

Many Jharkhand candidates for central posts belong to Scheduled Tribes or backward classes, and certificate problems are frequent. A central recruitment needs a certificate in the format prescribed by the advertisement, held by the closing date. The Supreme Court stressed both points in 2025, in Sakshi Arha and in Mohit Kumar. A Jharkhand state OBC certificate in the state format may be rejected for a central post, and a person from another state living in Jharkhand may not get the reserved status of Jharkhand.

Railway recruitment is a large share of these cases, and the RRB at Ranchi conducts many of them. The CAT hears disputes about central civil recruitment, including railway posts. Disputes about CAPF recruitment, such as SSC GD constable, generally go to the High Court. Our page on railway recruitment candidates explains what can and cannot be fixed after rejection.

Missteps we see in Jharkhand cases

  • A writ in the Jharkhand High Court as the first step. A central employee's service grievance must first go to the CAT. The High Court usually sends it back.
  • PSU staff filing at the tribunal. CCL, HEC or MECON employees lose time at the CAT; their forum is the High Court or the labour machinery.
  • Missing the zone or the Board. A railway case that names only the division, when the order came from the zonal office or the Railway Board, can stall.
  • Weak territory facts. As the 2017 Jharkhand High Court ruling shows, an order can be set aside years later if the case never belonged at the Ranchi circuit.
  • Sixty people, one petition, no list. Group cases help, but each applicant's details, posts and dates must be set out. Our page on joint applications by several employees shows how to prepare one.
  • Assuming the circuit will always be sitting. An urgent matter may need to go to Patna.

Travel, language and paperwork from Jharkhand

Ranchi is about 330 km from Patna by road, a day's travel each way, though day and overnight trains make it manageable. Clients from Dumka, Godda or Sahebganj in the Santhal Pargana may find Patna about as easy to reach as Ranchi. Most of our clients do not travel for routine dates.

Many departmental documents in Jharkhand are in Hindi, and some old GDS records are handwritten. Keep a typed English translation of key documents in case the registry asks; practice on this can vary. Scan everything at good resolution, and keep the originals safe at home rather than sending them by courier.

Officers, Group C staff and pensioners: different first steps

Group A and B officers in Ranchi, such as audit officers and income tax officers, often fight APAR gradings, DPC decisions and seniority, where the relevant files are in Delhi or Kolkata. Those cases may need RTI requests for DPC minutes before filing. Group C staff and GDS more often face recovery, pay fixation and disciplinary questions decided locally, where the first step is a representation and a request for documents.

Pensioners need their PPO and pay records in hand before anything else. Candidates need speed, because a selection process does not wait. Advocate B.K. Singh usually decides the first step only after seeing who signed the order and when, since that tells us whether to write, to appeal or to file.

How we handle Jharkhand matters from Delhi NCR

Our offices are in Dwarka, New Delhi and Vaishali, Ghaziabad. Jharkhand clients consult online, and we appear on brief at the Patna Bench and its Ranchi circuit, working with associate counsel there when a matter needs someone present at short notice. Writs and SLPs are handled with Advocates-on-Record where needed. Our page on the Patna Bench gives the wider picture for Bihar and Jharkhand, and our page on the Central Administrative Tribunal covers the basics.

Fees are talked through in the first meeting and agreed in writing, one stage at a time.

If you want your papers looked at, or wish to be told when the rules for Jharkhand employees and pensioners change, get in touch with Advocate B.K. Singh.

Frequently asked questions

Is there a CAT bench in Ranchi?

Not a permanent one. Jharkhand is under the Patna Bench, which has held circuit sittings in Ranchi. A petition seeking a permanent Ranchi bench is pending in the Jharkhand High Court, so check the latest position.

Will my case be heard in Ranchi or in Patna?

Jharkhand cases are usually listed when the Ranchi circuit sits. Urgent matters, or dates when no circuit is running, may be taken up at Patna. Check the cause list before each date.

I am a CCL employee in Ranchi. Can I go to the CAT?

No. CCL is a public sector company and is outside the tribunal. Officers generally file writs in the Jharkhand High Court, and workmen may use the industrial and labour forums.

Which High Court hears a challenge to a Ranchi circuit order?

The Jharkhand High Court has heard writs against orders made at the Ranchi circuit. For orders passed at Patna, the Patna High Court is the usual forum, though the facts can open the Jharkhand High Court too.

I am an RPF constable. Is my service dispute for the CAT?

Probably not. A Delhi High Court ruling of January 2026 held that serving RPF members' service disputes are not before the CAT, though RPF recruitment disputes are. Take advice on your exact issue.

My father retired from a central office in Odisha and lives in Ranchi. Where does he file?

As a retired person, he may file where he now ordinarily lives, which makes the Patna Bench available. The Cuttack Bench may also be open because the order came from Odisha.

I am a Jharkhand government teacher. Can the CAT hear my case?

No. State employees in Jharkhand go to the Jharkhand High Court. The CAT is only for central government posts and notified bodies.

What will the tribunal charge me to file?

The tribunal's own fee is Rs 50 under Rule 7, a small fixed amount; ask the registry if it has changed. Typing, copies, notary and courier make up the rest. Legal fees are settled in writing at the start.

Have a service dispute with the department?

Share the order, charge memo or pension papers with our advocates. You will learn the time limit that applies to you and the step to take first.
